1. Scope and Acceptance
These Terms and Conditions ("Terms") form a legally binding agreement between you and IT Learn for access to and use of our website, learning platform, and related services (the "Service"). By using the Service or creating an account, you agree to these Terms and our Privacy Statement.
If you do not agree, you must stop using the Service.
2. Definitions
- Service: all IT Learn web pages, APIs, course tools, account features, profile features, and support channels.
- User: any person using the Service, with or without an account.
- Content: text, code, profile data, feedback, and other materials displayed or submitted through the Service.
- Abuse: any use that violates these Terms, applicable law, security controls, or platform safety.
3. Eligibility and Accounts
You must be at least 13 years old to create an account. Where required by local law, users under 18 need parent or guardian permission.
You must provide accurate information and keep your credentials secure. You are responsible for all activity performed through your account, except where mandatory law states otherwise.
- Do not share credentials or accounts.
- Do not impersonate others.
- Notify us promptly if you suspect account compromise.
4. Acceptable Use and Anti-Abuse Rules
You must use the Service lawfully and responsibly. You must not:
- Use the Service for illegal activity or fraud.
- Upload malware or attempt unauthorized access.
- Interfere with platform security, performance, or availability.
- Automate abusive traffic, scraping, or bot actions without written permission.
- Manipulate progress, XP, badges, streaks, or gamification data.
- Harass, threaten, or abuse users or staff.
- Submit false reports, false profile information, or misleading identity data.
5. Enforcement, Suspensions, and Appeals
We may investigate suspected abuse and take action including warning, feature restriction, content moderation, temporary suspension, or permanent account ban.
Where available, banned users may appeal via our published appeals process (see Help/Support page).
If you abuse the Service, engage in fraud, or commit unlawful conduct, we may report relevant information to competent authorities, including your local police, to the extent permitted by law.
6. User Content, Reports, and Notice Procedures
If you submit profile text, report details, or other content, you confirm you have the right to submit it and that it is lawful and non-infringing.
We may review and moderate user-submitted profile content and abuse reports. False or malicious reporting is prohibited.
For takedown, legal notice, or infringement claims, contact abuse-ithelp-be@googlegroups.com with sufficient detail to identify the content and the legal basis of your request.
7. Intellectual Property and License
The Service and its content, including software, course material, design, and branding, are owned by IT Learn or its licensors and protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial learning use in compliance with these Terms.
You may not copy, resell, redistribute, reverse engineer, or create derivative works from protected material unless explicitly allowed by law or prior written permission.
8. Third-Party Services
The Service relies on third-party providers including infrastructure, authentication, and support services (for example Supabase, Cloudflare, PythonAnywhere, OAuth providers, Discord services, and Tawk.to). Their own terms and privacy policies may apply.
9. Service Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time for operational, security, legal, or product reasons. We may perform maintenance that temporarily impacts availability.
10. No Warranties and No Reliance
The Service is provided "as is" and "as available" to the fullest extent permitted by law.
Educational material is for learning purposes only and is not legal, financial, or professional advice. You are solely responsible for decisions and outcomes based on content or tools in the Service.
11. Limitation of Liability
To the maximum extent permitted by law, IT Learn is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, profits, revenue, goodwill, or business opportunities.
You use the Service at your own risk and are solely responsible for your actions, uploads, integrations, settings, and outcomes.
To the maximum extent permitted by law, IT Learn's aggregate liability for all claims related to the Service is limited to the greater of (a) amounts paid by you to IT Learn in the 12 months before the event giving rise to the claim, or (b) EUR 100.
Nothing in these Terms excludes liabilities that cannot legally be excluded under mandatory law.
12. Indemnification
You agree to defend, indemnify, and hold harmless IT Learn, its affiliates, and team members from all claims, liabilities, losses, damages, penalties, and costs (including reasonable legal fees) arising from your use or misuse of the Service, your breach of these Terms, your content, or your violation of law or third-party rights.
13. Governing Law and Disputes
These Terms are governed by the laws of Belgium, excluding conflict-of-law rules. Subject to mandatory consumer protections, disputes are handled by competent courts in Belgium.
14. Changes to These Terms
We may update these Terms. Material updates are published with a revised effective date. Continued use of the Service after the effective date means acceptance of the updated Terms.
15. Severability, Survival, and Entire Agreement
If one clause is held invalid, remaining clauses remain in force. Clauses on liability limits, indemnification, intellectual property, enforcement, and dispute handling survive termination or account deletion.
These Terms together with the Privacy Statement form the entire agreement between you and IT Learn for the Service.
